A deceased estate comes into existence when a person dies. When a person dies leaving a valid last will and testament, it is known as Testate Succession. When a person dies without a (valid) last will and testament, it is known as Intestate Succession.
The estate must be administered and distributed in terms of the deceased's will, or failing a valid will, in terms of the Intestate Succession Act. This procedure is prescribed by the Administration of Estates Act.
